MassageBook takes your
privacy seriously. Please read the following to learn more about our privacy policy, (this "Policy") which
describes how we treat personal information when you use the Website, as defined in our Terms of Service. This
Policy is part of the Terms of Service that govern all use of the Website. Any capitalized terms used but not
defined in this Policy are defined in the Terms of Service.
What This Privacy Policy Covers
This Policy covers MassageBook's treatment of personally identifiable information
that MassageBook collects (such as your first and last name, email address and phone
number) when you are on MassageBook sites, and when you use
MassageBook's services. This Policy also covers MassageBook's
treatment of any personally identifiable information that website service providers share with
MassageBook.
This Policy does not apply to the practices of companies that MassageBook does not
own or control or to people that MassageBook does not employ or manage.
The Website also collects information that does not personally identify you ("NonPII"), which is commonly
collected on the Internet. For example, we collect: the name of the domain and host for your Internet access
(e.g., AOL, MSN); your computer's Internet address, browser software and operating system; dates and times of
access or actions; and the Internet address you left before reaching us. We use NonPII for ordinary business
purposes, such as to measure web page flow and also to customize features. Generally, we do not share NonPII
with unaffiliated third parties other than our service providers but reserve the right to do so.
Information Collection
MassageBook collects personally identifiable information when you use certain
MassageBook products or services.
MassageBook may also receive personally identifiable information from Website service
providers.
MassageBook also automatically receives and records information on our server logs,
such as the browser you are using, your IP address, and the pages you requested.
Professional-Provided PII
If you are a Professional, you may have the opportunity to use the Platform to upload and store Customer contact
information and other data and personally-identifiable information about Customers (“Professional-Provided PII”).
When you upload Professional-Provided PII to the Platform, you represent and warrant that you have the right,
pursuant to your own data collection and privacy policies and all applicable laws, to upload such data to the
Platform and to appoint us as a processor of such data.
In addition, whenever you upload Professional-Provided PII, you represent and warrant that the Customers that
are the subject of such PII have provided their consent, in accordance with applicable law, to receive marketing
messages from you. If we offer a feature that allows you to send a request to a Customer confirming that you
have such Customer’s permission to send commercial messages to them (assuming such use is permitted by laws
applicable to you), and such Customer has not responded or does not respond affirmatively to such request for
confirmation, you agree that you shall not send non-transactional commercial messages to such Customer.
From time to time, we may send marketing messages to Customers whose data has been uploaded to the Platform as
Professional-Provided PII. You agree to import and upload Professional-Provided PII only for Customers that have
provided their consent, in accordance with applicable law, to have their PII shared with other parties for
purposes of receiving commercial messages unless and until we offer a feature on the Platform whereby you can
select which Customers have provided such consent. If and when we offer such a feature, you agree to accurately
maintain consents with respect to Professional-Provided PII.
You agree to indemnify and hold us harmless from and against any breach of your representations, warranties, or
obligations related to Professional-Provided PII, including your failure to procure appropriate consents from
Customers, your failure to maintain records of Customer consent for sharing of personally-identifiable
information with us, and claims that we have violated the CAN-SPAM Act or any other laws or regulations
regarding the use of personally-identifiable information with respect to Professional-Provided PII that has been
designated as approved for receipt of our commercial messages.
Customer-Provided PII
If you are a Customer and provide us with personally-identifiable information, you consent to our use of such
information to send you commercial and marketing messages; however, you may unsubscribe or update your
preferences at any time by logging onto your MassageBook account or writing to us at
support@massagebook.com. Note that even if you opt out of receiving commercial messages, we will still use your
email address for transactional and administrative purposes such as notifying you of major Website changes or
for customer service purposes.
Protection of Personal Health Information (PHI)
MassageBook supports customers who are subject to the requirements of the Health Insurance Portability and
Accountability Act (HIPAA). Under HIPAA, certain information about a person’s health or health care services is
classified as Protected Health Information (PHI). If You are subject to HIPAA and wish to use Our Services with
PHI, it is Your responsibility to request a Business Associate Agreement (“BAA”) with MassageBook. You are
solely responsible for determining whether You are subject to HIPAA requirements. If You are subject to HIPAA
and have not entered into a BAA, You must not use any of Our digital properties in connection with PHI. You
agree to indemnify, defend, and hold harmless 2Book, Inc., MassageBook and its directors, employees, and
affiliates against any claim relating to a failure by You to request a BAA with MassageBook.
Information Sharing and Use
MassageBook shares personally identifiable information with the businesses where you
schedule reservations.
MassageBook may also use this information to customize your experience on the Website
and to present Website users with web advertisements of interest to you based on your scheduling activities.
We use both your personally identifiable information and certain NonPII (such as anonymous user usage data,
cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Website
and to create new features, promotions, functionality, and services by storing, tracking, analyzing, and
processing user preferences and trends, as well as user activity and communications.
How to Unsubscribe
To unsubscribe from a service provider's mailing list, use the Unsubscribe link that is available in each email
you receive from them. This does not suppress emails sent directly from service providers using services other
than MassageBook's. Unsubscribing only suppresses emails sent on the initiative of
service providers using MassageBook's services with whom you have an existing
business relationship. Note that even after you unsubscribe, you will continue to receive transactional email
messages regarding the status of reservations you schedule. To prevent your mailbox from receiving unwelcome
correspondence, each service provider using MassageBook's services maintains an
opt-out list for electronic mailings you may receive from them.

your account settings or email us at support@massagebook.com.
Cookies
MassageBook may set and access cookies on your computer.
MassageBook may allow other companies to use cookies,
or use electronic images (e.g., GIFs) that allow a website to count users who have visited that page or to
access certain cookies. We do this to improve and enhance the functionality of our Website. If you choose to not
allow a cookie on your computer, our Website may not work correctly.
We also may use cookies, clear gifs, log file information, and other tracking mechanism. We may use this
information for any lawful purpose, including to: (a) store information so that you will not have to re-enter it
during your visit or the next time you visit the Website; (b) provide custom, personalized content and
information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as
total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in any
promotions, sweepstakes and contests.
Third-party Advertisers, Links to Other Websites
MassageBook allows other companies, called third-party ad servers or ad networks, to
serve advertisements within the Website. These third-party ad servers or ad networks use technology to send,
directly to your browser, the advertisements and links that appear on the Website. They automatically receive
your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web
beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see.
Please note that if an advertiser asks us to show an advertisement to a certain audience (for example, women
ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and
you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the
audience they are trying to reach. The advertiser may also use information regarding your use of the Website,
such as the number of times you viewed an ad (but not any personally identifiable information), to determine
which ads to deliver to you.
You should consult the respective privacy policies of these third-party ad servers or ad networks for more
information on their practices and for instructions on how to opt-out of certain practices. This Policy does not
apply to, and we cannot control the activities of, such other advertisers or Websites. Any data obtained by
third-party ad servers subsequently shared with us is maintained in accordance with this Policy.
Online Tracking and Your Choices
As mentioned above, we track website usage information through the use of cookies for internal purposes (e.g.,
to improve and enhance the functionality of our Website). Therefore, your selection of the "Do Not Track" option
provided by your browser may not have any effect on our collection of cookie information for these purposes. The
only way to completely "opt out" of the collection of any information through cookies or other tracking
technology is to actively manage the settings on your browser or mobile device to delete and disable cookies and
other tracking/recording tools. However, getting a "Do Not Track" signal actually to work as you might want is
actually very hard. Using browsers as an example, not all tracking technologies can be controlled by browsers;
unique aspects of your browser or device might be recognizable even if you disable a tracking technology; not
all settings will necessarily last or be effective; even if a setting is effective for one purpose data still
may be collected for another; and even if one website observes a "Do Not Track" signal, that website usually
will not be able to control what websites do.
In addition, as mentioned above, MassageBook may allow other companies (e.g., ad
partners, ad servers and ad networks) to use cookies and other technology to collect information about your
browsing activities over time and across different websites when you use our Website. For example, we may use
advertising services provided by third party ad partners, to market our services to you on other websites.
Through a process called "retargeting," each service may place a cookie on your browser when you visit our
Website so that they can identify you and serve you ads on other sites around the web based on your browsing
activity. To avoid tracking by these third party ad partners, you can change your browser settings to reject
cookies or to notify you when cookies are set and you could select the "Do Not Track" option on your browser,
although we have no control over and cannot confirm whether these third party ad parties honor the "Do Not
Track" browser signal. Additionally, many advertising companies are members of the NAI or DAA and provide
opt-outs on those industry pages at networkadvertising.org/choices or aboutads.info/choices.
Disclosure of Information
We reserve the right to use, disclose, share, sell, retain and otherwise deal with (collectively "disclose") all
information collected via the Website, internally or to third parties, for any lawful purpose or to prevent harm
to us or others. For example and without limitation, in our discretion we may disclose information:
Information About Security
For transactions involving credit or debit cards, service providers should use secure socket layer (SSL)
encryption to protect the transmission of credit or debit card information through our Website.
Your emails to us are not necessarily secure against interception and you should not include sensitive
information in those emails – we generally will not ask for your credit or debit card number, password,
prescription or other sensitive information in an email and you should assume that if you get such a request,
it might be fraudulent.
Except for the SSL transmissions, the Website is not encrypted, except for your personal health information,
which is encrypted to HIPAA standards. Access to your user data is restricted by your password.
Neither passwords nor security systems, including encryption, are foolproof or necessarily work as intended.
Furthermore, people can commit intentional crimes, make mistakes or fail to follow policies. Although we take
what we believe are commercially reasonable security precautions, we do not guaranty the security of information
and you agree to do what you reasonably can to help promote security (such as by not sharing your password with
anyone). We are required in some circumstances (e.g., if you are a resident of California and other conditions
are met) to disclose an invasion of certain security systems. We will give that notice when required, either by
posting it on the Website or by giving notice at your email address on file with us, in our discretion. You
agree to check the Website periodically, particularly if you use spam filters, which can sometimes
mischaracterize and block emails.
Changes to This Policy
We reserve the right to change this Policy in our discretion in accordance with the provisions in the Terms
regarding amendments. If we make any substantial changes we will notify you by posting a notice with our revised
version of this Policy, and through any other means, such as notices on the Website, that we deem appropriate
and reasonable.
Note About Children's Privacy Issues
MassageBook's primary audience is adults looking to schedule reservations with
massage and bodywork service or resource providers.
If a child under the age of 13 has provided his or her personal information, a parent or guardian may so inform
us by emailing Support@MassageBook.com or calling 843-352-2026, and we will use
commercially reasonable efforts to delete that child's personal information from our database (subject to

California Minors
If you are a California resident who is under 18 and a registered user of our Website (e.g., created a user
account on our Website), this section applies to you. MassageBook may provide
registered users the functionality of posting information on our Website. If and to the extent CA Bus. & Prof.
· 22581 applies, you may request and obtain removal of content or information posted by you (as an account
holder of MassageBook) subject to the exceptions provided in this "California Minors"
section. If you can accomplish removal on your own by following the instructions on our Website, then follow
those instructions. If that won't work, contact us by using the contact information provided in the "Contact Us"
section in at the bottom of this Policy by specifying the information or content and each location of it in
enough detail so that we reasonably can find it and meet your request in the ordinary course of our business.
CA Bus. & Prof. · 22581 provides exceptions to your ability to request and obtain removal of content or
information posted by you on our Website. Those exceptions in CA Bus. & Prof. · 22581 are: (1) federal or state
laws requiring us or a third party to maintain the content or information; (2) the content or information isn't
covered by the law (e.g., someone other than you posted it or your posting is stored, republished, or reposted
by a third party); (3) we turned your content or information into anonymized data (such as, aggregated data or
the like), thereby disabling the ability to identify your content and information among other users' content or
information; (4) you don't follow our instructions for removing or requesting removal; or (5) you received
compensation or other consideration for providing the content or information. If any one of the above exceptions
applies, we are not required to remove your content or information from our Website.
REMOVAL OF YOUR POSTED CONTENT OR INFORMATION FROM OUR WEBSITE DOES NOT ENSURE COMPLETE OR COMPREHENSIVE REMOVAL
OF THAT CONTENT OR INFORMATION. The law does not require us to actually eliminate the information posted by you;
the law is satisfied if we keep it but render it invisible to other users and the public. Also, some information
will already be beyond our control (e.g., a user or other third party might have already copied it). Law
enforcement may obtain the content or information pursuant to certain court orders.
California Shine the Light Law
California Civil Code Section 1798.83 permits California residents to request and obtain from us once a year,
free of charge, a list of the third parties to whom we have disclosed personal information (as defined under
that statute) of that California resident, for direct marketing purposes in the preceding calendar year and the
categories of that kind of personal information that was disclosed to them. If you are a California resident and
you wish to make such a request you may contact us by using the contact information in the "Contact Us" section
at the bottom of this Policy.
Submitting a Claim for Identity Theft
If you or any other person believes they are a victim of identity theft, and are therefore entitled by law to
request certain business records in our control, we will attempt to verify the claim as allowed by law. You need
